To many people, orphan works may seem like the equivalent of small change, the miscellaneous detritus at the back of the information filing cabinet that has fallen out of the folders. The truth, though, is rather different. There is a vast amount of highly valuable material in the world whose unknown authorship results in its custodians keeping it offline and generally inaccessible out of fear of the legal consequences of copyright infringement. The resulting loss of follow-on creativity prevents knowledge economies like Britain's from fully exploiting the information fuel that drives the knowledge engine. The UK government is hoping that its Digital Economy Bill will address some of the long-standing problems associated with orphan works. And those problems are growing. Even as the Bill tries to define a legal solution for access to and preservation of work without an identifiable copyright holder, technology is adding to the multiplicity of ways in which data can be created, adapted, mashed, repurposed, copied and published. The Bill, which could be passed before the general election, outlines the usage rights of orphan works, but some of its clauses, as well as strong objections to it and the impending moratorium before the election, show that a solution is still far from sight.
